These Terms and Conditions (‘Terms’) are an agreement between you (‘User’) and Azimap, operated by Cianad Software Ltd., a company registered in the UK under company number ASK ADMIN with its registered office address at Union House, Union Place, Cookstown, Co. Tyrone, BT80 8NP. Please read them carefully. They apply to the Azimap software application, including any updates or supplements for the application.
If you do not accept these terms, you will forfeit the right to use Azimap.
If you comply with these licence terms, you have the rights below.
Internet-Based Services
Azimap connects to computer systems over the Internet, which may include a wireless network. Using the application operates as your consent to the transmission of standard device information for internet-based or wireless services. If other terms are presented in connection with third-party services via the application (e.g. geocoding, base maps), those terms also apply and may supersede these in relation to that service.
Hosted Services
Azimap will aim to achieve optimum uptime for users accessing the application via Azimap.com. You acknowledge that Azimap will take reasonable measures to ensure the accessibility of embedded or shared maps. However, you acknowledge that technical or external factors beyond our control may cause temporary unavailability. In such cases, Azimap is not liable for any consequential loss.
Subscription Terms of Use
Your subscription grants you limited rights to use the Azimap Software-as-a-Service. Your licence is non-exclusive, non-transferable, and is granted solely for your internal business or personal use.
If Azimap terminates your ability to use the service, any associated licence rights will be terminated with immediate effect. Unless applicable law gives you more rights despite this limitation, you may use the Azimap software only as expressly permitted in this agreement. In doing so, you must comply with any technical limitations in the application that only allow you to use it in specific ways. You may not:
Reverse engineer, decompile or disassemble the application, except and only to the extent that applicable copyright law provisions for computer programmes expressly permit it
Make more copies of the application than specified in this agreement or allowed by applicable law, despite this limitation
Publish or otherwise make the application available for others to copy
Rent, lease, or lend the application
Transfer the application or this agreement to a third party
Creating an Account
You can create an Azimap account by subscribing to one of the subscription models on azimap.com. On creating your account, you agree not to use any false, inaccurate or misleading information for your personal or business details. By creating an account, you confirm that you are at least 18 years old and that you agree to be bound by these Terms.
You cannot transfer your Azimap account to another user or entity.
To protect your account, keep your account details and password confidential. You are responsible for all activity that occurs under your Azimap account.
Marketing Communications & Contact
Azimap provides a 30-day free trial of the professional account.
By signing up for the free trial, you consent to Azimap contacting you by email for product and feature updates. You may withdraw your consent at any time by contacting marketing@azimap.com or using the unsubscribe link provided in the email.
Once your 30-day free trial has ended, the user's account will automatically be downgraded to the basic subscription level. However, Azimap will aim to provide you with prior notification of this before the end of your free trial. Once your free trial has ended, you can still sign in to your Azimap account using your existing username and password. However, the data allowance and feature options will be downgraded. Account Use
You must verify and activate your Azimap account upon signing up for an Azimap subscription. A verification email will be sent to the email address used to create your account. Only when your account has been activated will you be able to start using Azimap Web GIS. If you don’t verify this email, you will not be able to sign into Azimap Web GIS.
If we suspect that your Azimap account is being used by a third party fraudulently, Azimap may suspend your account until you can reclaim ownership. If you are having trouble accessing your Azimap account, contact support@azimap.com for assistance regaining access.
If your account remains inactive for more than 12 months, we may notify you before initiating deletion or suspension.
Support Services
If support or assistance is required, please contact the customer support team via the support desk or by emailing support@azimap.com. Note that Azimap is not responsible for providing support services for the application unless a suitable service level agreement (SLA) is in place. If applicable, SLA terms will be set out in your subscription or enterprise contract.
We will endeavour to respond to all support enquiries in a professional and timely manner. Azimap does provide an onboarding remote training service to help educate users on how best to use Azimap. This is available upon request.
System Updates
We will carry out periodic system updates to the core Azimap application, which may include bug fixes, enhancements and the introduction of new features. We endeavour to undertake releases during periods of low user engagement and aim to keep the disruption of services to a minimum. By agreeing to these Terms and Conditions, you accept that some downtime of the application might be incurred during any production releases.
Your Data/Content
If you do not want third parties to access your data/content, make sure to use the private function when creating your maps. This is the default setting when creating a new map.
However, a key feature of the Azimap Web GIS is the creation of public maps that can be shared or embedded into third-party websites.
We act as a data processor when handling personal data you input into the system. You retain all rights to your data. Azimap will process and store your content only as necessary to provide the services, in accordance with our Privacy Policy and applicable data protection laws.
It’s important to note that we do not take ownership of your data or content. Your data/content will remain yours, and therefore, you alone are responsible for it. If you share data with third parties, you explicitly agree that your content can be shared and communicated with others beyond your control.
Sharing of Data/Content
If you decide to share your data/content with third parties, Azimap is unable to track where this is being promoted or communicated, for example, a promotional map going viral. By sharing your data/content, you assume full responsibility for it, and Azimap is under no obligation to monitor, review, or record where your content is promoted or communicated. The onus is on the account holder to monitor and manage the use of their data/content, and Azimap accepts no responsibility for this.
You must ensure that any content you share does not infringe third-party rights or violate applicable laws.
Update to the Service or Software and Changes to the Terms and Conditions
We'll inform you by email if we intend to change these Terms and Conditions. We may change these if necessary due to
Applicable law, including, but not limited to, a change of such law;
Advice and/or order based on applicable law;
The evolution of the Services;
Technical reasons;
Operational requirements or
An advantageous change of terms for the user
We will give you at least 14 days' notice for material changes to the services or these terms, unless a shorter notice is required by law or security concerns, either via www.azimap.com, in an email or through other reasonable means, such as social media. By using our services after the changes take effect, you are consenting to the new terms. If you do not agree to the new terms, you must stop using the services and terminate your Azimap account as stipulated in your service agreement. We'll also explicitly point to this fact when informing you about the intended change of these Terms.
You may be required to update your internal infrastructure, network or browser settings to ensure full use of Azimap's features. Azimap is not obligated to make any updates available and doesn't guarantee that we will support the version of the system for which you licensed the software. If support is required, please consult the support service terms.
We are continuously working to improve Azimap and may change services or delete features at any time without prior notice. However, we will aim to inform you of our intent to change the system via email or an alternative suitable method. For customers who have opted for a paid subscription, we'll notify you in advance of material changes to the services.
We will also notify you in advance if a change to the services will cause you to lose access to your content.
Terminating your account
In addition to any right to cancel your account, as specified in the Service Agreement. To permanently close your account, please contact support@azimap.com. We will guide you through the process, and our customer support team will be happy to assist you.
After your account is terminated, your data will be deleted from our active systems after 60 days. You are responsible for backing up your content prior to deletion. Residual data may persist in encrypted backups for up to 14 days in accordance with our retention policy.
